Whaley was born March 6, 1962 in Charleston, South Carolina, son of Dr. Whaley R. Hinnant, Jr. (Sharon) and Janet Regan Smith. He was owner operator of Whaley's Plumbing Repair. He was a member of Bethel United Methodist Church.

He is survived by his father, Dr. Whaley R. Hinnant, Jr. (Sharon) of Charleston, SC, mother, Janet Regan Smith of Charleston, SC, sister, Lynn Hinnant Richmond (Michael) of Mt. Pleasant, SC, and an uncle, Owen Regan (Patsy) of DeLeon Springs, FL.
